A new and controversial scenario in the gathering of evidence at the European level: The proposal for a directive on the European investigation order

2014

In April 2010 a group of EU Member States proposed a Directive on the European Investigation Order, an instrument which, if adopted, will significantly change the way in which evidence is gathered at the EU level. After the failure of the EEW, which focused on the exchange of evidence which had already been gathered, the objective of the new text is to create a single instrument for obtaining all kinds of evidence located in another Member State. The aim of this paper is to examine, within the current framework, the suitability of this new instrument, with particular reference to its impact on the rights of defendants.

El propósito de este artículo es analizar las aristas de la Directiva sobre la Orden Europea de Protección cuando se trata de proteger a las víctimas de violencia de género. El inexistente concepto de víctima de violencia de género dificulta sobremanera el adecuado uso del instrumento y nos muestra cuánta Europa queda por construir. Al final del artículo proponemos la creación de una medida cautelar civil para acercarnos al resto de ordenamientos jurídicos de nuestro entorno y facilitar el reconocimiento mutuo.

El presente texto reflexiona sobre algunas experiencias asociativas de las mujeres de distintas organizaciones femeninas de izquierda durante la Segunda República española (1931-1936). A través de ellas, las mujeres aumentaron su presencia pública en este período, sus vinculaciones y su compromiso, a través de múltiples acciones y propuestas. Pero a la vez, estas experiencias incrementaron el contacto y la interacción entre ellas, posibilitando su reconocimiento mutuo, su «apoyo mutuo», y con él, el desarrollo de su conciencia y de su identidad como mujeres, como socialistas y como trabajadoras.
